    Job Description

    We are looking for a Program Manager to support our work at NIH. The position will be based in Bethesda/Rockville, MD

    Responsibilities

    • Provide professional acquisition support services to NIAID in establishing its acquisition requirements relative to its intellectual property needs; ensure that appropriate Intellectual property provisions are included in NIAID contracts and grants.
    • Review and edit intellectual property transactions to ensure compliance with the Federal Acquisition Regulation (FAR) and other Federal law, subject to review by the Office of the General Counsel.
    • Review and edit draft contract and solicitation provisions; review and edit various agreements with extramural entities including, for example, software license agreements, nondisclosure agreements, and clinical trial agreements.
    • Evaluate the effects of intellectual property laws and government intellectual property policies on NIAID's programmatic goals and proposing effective means for accomplishing those goals consistent with law and policy, including proposed terms for Determinations of Exceptional Circumstances (DEC) or alternatives to such Determinations.
    • Coordinate evaluations and proposals with NIAID program staff and draft such DECs or alternatives.
    • Provide instruction and training to NIAID program staff in reviewing terms and conditions under solicitations, contracts, license agreements for software nondisclosure agreements, and other agreements related to intellectual property.
    • Instruction and training shall cover the review of U.S. patent and copyright law, as well as other statutes that affect the intellectual property rights of the parties under those agreements.
    • Review current NIH policy on negotiating and approving contracts and OECs.
    • Ensure that terms and conditions are negotiated that protect NIAID's interests under license agreements.
    • Develop draft guidance, including tutorials, for NIAID's program staff in reviewing and negotiating contracts and license agreements for software and other intellectual property.

    • Work products and documents related to providing instruction and training to NIAID program staff in reviewing terms and conditions under solicitations, contracts, license agreements for software nondisclosure agreements, and other agreements related to intellectual property.
    • Work products and documents related to developing draft guidance, including tutorials, for NIAID's program staff in reviewing and negotiating contracts and license agreements for software and other intellectual property.

    Requirements:

    • At least 4 years of related experience
    • Experience with federal Acquisition Regulation (FAR) and other Federal law
    • Strong knowledge and experience with intellectual property laws and government intellectual property policies
    • NIH experience is highly preferred
